1. Participation
a) Eligible participants
Eligible to participate in the HeimatGenuss Card program (formerly RinghotelsCard, HeimatGenuss Card Silver and HeimatGenuss Card Gold) are natural persons over the age of 18. Legal entities, partnerships and employees of Ringhotels and Ringhotels e.V. are not eligible to participate.
b) Start of participation
Participation begins with the notification of the personal HeimatGenuss Card number at the hotel reception of a Ringhotel or through the Ringhotels service office of Ringhotels e.V. or by sending the personal HeimatGenuss Card, which only takes place at the request of the participant. The HeimatGenuss Card Silver and HeimatGenuss Card Gold will be sent automatically. Only one Ringe account can be opened per person. The HeimatGenuss Card remains the property of Ringhotels e.V., is non-transferable and must be returned to Ringhotels e.V. at the end of participation in the HeimatGenuss Card program. The loss, theft or damage of the HeimatGenuss Card should be reported immediately to Ringhotels e.V. so that a new card can be issued.
c) Termination
Participation in the HeimatGenuss Card program can be terminated in writing by either party at any time without observing a notice period and without giving reasons. Reward rings not yet redeemed by this time must be used within 6 months of receipt of the notice of termination before they expire without replacement. If no reward rings are collected for 24 months, participation in the HeimatGenuss Card program ends at the end of the next quarter without the need for termination.
2. Collecting rings
a) Collecting
Ringhotels rings (bonus rings and status rings) can be collected from the start of participation (section 1.b). For this purpose, the cardholder must provide his/her HeimatGenuss Card number for each hotel stay. Subsequent crediting of Ringhotels Rings is not possible. The cardholder receives Ringhotels Rings on the turnover made personally in a Ringhotel in connection with at least 1 overnight stay. For every €10.00 spent, 3 reward rings and 3 status rings are credited. The cardholder's turnover from overnight stays, food and beverages, as well as the hotel's own ancillary services without external ancillary services and third-party providers (e.g. visitor's tax, travel vouchers, booking portals) is taken into account. The cardholder also receives bonus rings for third-party turnover, i.e. turnover not made personally without external ancillary services and third-party providers (e.g. visitor's tax, travel vouchers, booking portals), such as group stays and family events, up to € 3,000.00 for the HeimatGenuss Card, up to € 6,000.00 for the HeimatGenuss Card Silver and up to € 9,000.00 for the HeimatGenuss Card Gold.
b) Status
No minimum purchase is required for the HeimatGenuss Card. Upon reaching 800 status rings in the current calendar year, the participant receives the HeimatGenuss Card Silver on January 1 of the following calendar year and upon reaching a further 1200 status rings, the HeimatGenuss Card Gold on January 1 of the following calendar year.
c) Birthday rings
Upon receipt of the HeimatGenuss Card Silver or HeimatGenuss Card Gold, the participant will be credited with an additional 100 bonus rings for each of their future birthdays with proof of their date of birth.
d) Bonus rings
Holders of the HeimatGenuss Card Silver or HeimatGenuss Card Gold receive additional bonus rings on their sales (own sales and third-party sales up to € 6. 000.00 for the HeimatGenuss Card Silver and up to € 9,000.00 for the HeimatGenuss Card Gold) in addition to their bonus rings in the amount of 10% for the HeimatGenuss Card Silver and 20% for the HeimatGenuss Card Gold.
e) Account balance
The collected rings are managed in a central database at Ringhotels e.V.. The current ring balance can be requested at any time by telephone from the Ringhotels service office, online in the password-protected area at www.ringhotels.de or during a stay at a Ringhotel. On request, the account statement can be sent to the participant by post. For holders of the HeimatGenuss Card, 50 bonus rings will be redeemed for sending the account statement.
f) Assignment
It is not possible to assign the collected rings to other cardholders.
3. Redemption of rings
a) Rewards
Each participant can redeem their reward rings for non-cash rewards or other rewards as soon as their ring account has the required number of rings for the respective reward. The reward must be requested from Ringhotels e.V. in writing or online in the password-protected area at www.ringhotels.de, stating the cardholder and the HeimatGenuss Card number. If the desired reward is not available, Ringhotels e.V. will inform the
participant immediately so that he/she can choose another reward. The accumulated reward rings will not be reimbursed in cash. For the shipment of a non-cash award to an area outside the Federal Republic of Germany, an additional 100 award rings must be redeemed.
b) Expiration of award rings
If a hotel award is canceled late, the award rings accumulated for it expire. The cancellation deadlines of the respective ring hotel apply. If the award rings are not redeemed for an award within 3 years of purchase, they will expire without replacement at the end of the next quarter. The expiry of the reward rings is not based on the day on which they are credited, but on the number of reward rings collected each quarter. The participant can query the time and extent of the expiry of reward rings at any time in accordance with section 2.e). For holders of the HeimatGenuss Card Silver or HeimatGenuss Card Gold, the rewards rings will not expire until the HeimatGenuss Card Silver or HeimatGenuss Card Gold expires.
c) Expiry of status rings
The HeimatGenuss Card Silver is valid for two calendar years and the HeimatGenuss Card Gold for three calendar years. If the holder of the HeimatGenuss Card Silver does not reach 800 status rings in the second calendar year after receiving the HeimatGenuss Card Silver, his/her status rings expire on January 1 at 00:01 of the third calendar year. If the holder of the HeimatGenuss Card Gold no longer reaches 1,200 status rings in the third calendar year, his/her status rings will expire on January 1 at 00:01 of the fourth calendar year. This means that if less than 1,200 but more than 799 status rings are achieved, the participant will receive a HeimatGenuss Card Silver instead of the HeimatGenuss Card Gold from the fourth calendar year onwards and a HeimatGenuss Card Silver instead of the HeimatGenuss Card Silver from the third calendar year onwards if less than 800 status rings are achieved. In the case of a HeimatGenuss Card Silver repeated over six calendar years and a HeimatGenuss Card Gold repeated over nine years, the participant receives a lifetime HeimatGenuss Card Silver or HeimatGenuss Card Gold.
4. Miscellaneous
a) Program termination
Ringhotels e.V. reserves the right to terminate the HeimatGenuss Card program at any time without giving reasons or to replace it with another program and to terminate the participation contracts in writing without observing a notice period. Section 1.c) applies to the rings purchased up to that point.
b) Data protection
The personal data associated with participation will be processed for purposes that serve the implementation of the HeimatGenuss Card program. The Ringhotels data protection provisions apply, which can be accessed at www.ringhotels.de/datenschutz.
c) Changes
Ringhotels e.V. reserves the right to make changes or additions to the conditions of participation and rewards at any time. The changes or additions to the conditions of participation are deemed to be approved and become part of the contract at if the participant does not object to them in writing within 1 month of becoming aware of them. If a participant objects to a change or addition, Ringhotels e.V. may terminate the contractual relationship in writing with a notice period of 2 weeks. Section 1.c) applies to the rings purchased up to that point.
d) Liability
Ringhotels e.V. or a Ringhotel and its employees and vicarious agents are not liable for damages incurred by participants in connection with their participation in the HeimatGenuss Card program for slight negligence, with the exception of damages resulting from injury to life, limb or health.
e) Applicable law
The law of the Federal Republic of Germany applies exclusively. Place of fulfillment is Munich.
